Al acceder y realizar un servicio con Synergy Education, Usted confirma que está de acuerdo y sujeto a los términos de servicio contenidos en los Términos y Condiciones que se describen a continuación. Estos Términos y condiciones se aplican a todo el sitio web y a cualquier correo electrónico u otro tipo de comunicación entre Usted y Synergy Education.
Synergy Education manifiesta que cumple con la Ley Federal de Protección al Consumidor y la Norma Mexicana NOM-174-SCFI-2007, Prácticas comerciales-Elementos de información para la prestación de servicios en general, Disposiciones a las que se sujetarán aquellas personas que ofrezcan, comercialicen o vendan bienes, productos o servicios.
Synergy Education, se compromete a mantener públicos los Términos y Condiciones para la prestación del servicio ofertado en la página electrónica: https://www.synergyforeducation.com/. Para una debida información al usuario, JAC 7 S.A.P.I DE C.V. declara que es una empresa legalmente constituida, conocida como marca comercial bajo la denominación Synergy Education, por lo que manifiesta que su domicilio físico en territorio nacional se ubica en Calle Colima número 130 (ciento treinta), en la Colonia el Mante, en el Municipio de Guadalajara, Jalisco. Synergy Education no será responsable de ningún resultado que pueda ocurrir durante el curso del uso de nuestros recursos. Nos reservamos el derecho de cambiar los precios y revisar la política de uso de recursos en cualquier momento.
Estos Términos y Condiciones son un contrato entre Usted y JAC 7 S.A.P.I DE C.V. (referidos en estos Términos y Condiciones como, Synergy Education, “Sinergeticos”, “nosotros", o "nuestro") y los servicios accesibles de manera presencial y/o desde el sitio web del programa Synergy Education (que se denominan colectivamente en estos Términos y Condiciones como el "Servicio", “programa”).
Al momento de ingresar a Synergy Education, Usted acepta estar sujeto a estos Términos y Condiciones. En caso de alguna situación de insatisfacción derivado de los servicios y/o el programa, Usted deberá de tener en consideración que acepta libremente los presentes Términos y Condiciones, por lo que se espera la observación y seguimiento de los mismos.
En estos Términos y Condiciones, "Usted" se refiere tanto a Usted como individuo, usuario y como a la entidad que representa. Si viola cualquiera de estos Términos y Condiciones, nos reservamos el derecho de cancelar o bloquear el acceso a los servicios de Synergy Education.
INFORMACIÓN DEL SERVICIO.
Synergy Education manifiesta que la información que se proporciona sobre los servicios ofertados, es veraz, comprobable, clara y se encuentra exenta de textos, diálogos, sonidos, imágenes o alguna otra figura que induzca o pueda inducir a error o confusión al usuario.
Synergy Education manifiesta que la información de los servicios ofrecidos contiene al menos los siguientes datos:
a) La descripción del servicio, incluyendo fecha, Iugar y hora en que se llevará a cabo, duración, plazo, quiénes intervendrán en el mismo; también se deberá indicar si se subcontratará a una persona física o moral para prestar los servicios en cuyo caso deberá proporcionar los datos de identificación de la misma. Synergy Education garantizará que los proveedores que utilicen la página de internet para la comercialización de sus servicios, incluirán toda la información respecto de éstos;
b) Deberá informar sobre el plazo de las garantías;
c) Las restricciones del servicio, que en su caso apliquen;
d) El monto total a pagar en moneda nacional o en dólares (USD) con el valor que se indica dentro de los presentes Términos y Condiciones, y cualquier otra contribución u otros cargos adicionales, en su caso, las bonificaciones en efectivo, premios, descuentos, así como la vigencia de éstos, además de mencionar si existen cargos recurrentes y procedimiento de modificación de los mismos;
e) En su caso, el procedimiento para la renovación, modificación, terminación anticipada o cancelación del servicio,
f) Cuando se ofrezcan servicios adicionales a los originalmente contratados se le deberá informar por escrito al consumidor tal circunstancia para que manifieste su consentimiento con los mismos;
g) En caso de tratarse de transacciones internacionales, Synergy Education debe incluir un aviso relativo a la posible aplicación de impuestos a la importación o cualquier otro que en su caso aplique, así como las consecuencias de la omisión de pago;
h) Las demás condiciones aplicables establecidas en el artículo 7 de la Ley Federal de Protección al Consumidor.
En consecuencia, el usuario manifiesta que es conocedor de las especificaciones, características, condiciones, términos, plazos de entrega y precio total que aplican al servicio elegido.No obstante lo anterior, Synergy Education manifiesta que el usuario, podrá realizar cambios en cualquier selección o sección de servicios, así también el usuario podrá consultar la información sobre el servicio antes de aceptar la transacción.
Para concretar la adquisición del servicio, el usuario, dentro de Synergy Education, deberá manifestar su consentimiento para la adquisición del mismo, aceptar los presentes Términos y Condiciones, manifestando el conocimiento y aceptación de los mismos. Posteriormente deberá seleccionar la opción de forma de pago que más le favorezca.
El usuario al adquirir cualesquiera de los servicios dentro de Synergy Education, se entenderá que tiene conocimiento para la adquisición del mismo, por lo cual acepta los presentes Términos y Condiciones.
Synergy Education deberá entregar al usuario el comprobante de la transacción realizada, en el cual se deben considerar al menos los siguientes puntos:
a) Al realizar el pago Synergy Education, hará llegar al correo proporcionado por el usuario el comprobante de pago de la transacción realizada.
b) Permitir el seguimiento de la transacción comercial, a través del número de transacción o número de cuenta en Hotmart, Stripe, Mercado Pago, Proveedor y/o Tienda \/irtuaI
c) Informar los medios de contacto o ayuda en caso de modificaciones o errores a nuestro equipo de soporte técnico llamando al número telefónico +523328116675, y/o correo electrónico [email protected]
d) El medio en que se entregarán o pondrán a disposición del Consumidor el comprobante fiscal (factura electrónica), los cuales se emitirán sin ningún costo para el consumidor.
A solicitud del usuario, Synergy Education además deberá entregar el comprobante fiscal que ampare la transacción comercial de mérito.
Synergy Education manifesta que ha hecho del conocimiento del consumidor que puede calificar los servicios ofertados, manifestando su experiencia de la transacción comercial. Synergy Education se obliga a publicitar las evaluaciones y opiniones de los consumidores.

Synergy Education está abierta para cualquiera que cumpla con los siguientes requisitos:
• Ser mayor de 18 años. Debe tener al menos 18 años para convenir y aceptar estos Términos de Servicio en nombre propio.

Al realizar la compra de nuestros servicios, Usted se compromete a cumplir con nuestros Términos y Condiciones de uso. Tenga en cuenta que los precios, promociones y disponibilidad de servicios están sujetos a cambios sin previo aviso. Recomendamos verificar la información al momento de la compra.

APARTADO.
Synergy Education otorga la facilidad de otorgar por concepto de “apartado” un monto de dinero para la inscripción a cualquiera de nuestros cursos y/o programas parte de Synergy Education, Se informa que todos los pagos realizados para el apartado de productos y/o servicios de Synergy Education son definitivos y no serán reembolsados bajo ninguna circunstancia. Al realizar el pago, el cliente confirma su aceptación de esta política de no reembolso, renunciando expresamente a cualquier solicitud de devolución por cualquier motivo relacionado con la compra o el servicio contratado
FACTURACIÓN.
Para poder solicitar la facturación del pago cualquiera de nuestros cursos y/o programas en Synergy Education, se deberá de realizar el pago total del costo de esta dentro del mismo mes en que se solicite.
Los pedidos de facturación podrán solicitarse conforme los siguientes pasos:
1. Realizar la compra y el pago total de los o el curso y/o programa parte de Synergy Education, una vez completado el proceso de pago, se deberá tener a mano la información del método de pago que se utilizo
2. Se deberá de preparar el comprobante de pago correspondiente de los o el curso y/o programa parte de Synergy Education, es importante que el comprobante incluya la siguiente información:
• Fecha de la compra
• Monto pagado
•Detalles del método de pago que se utilizo
3. Deberás de contar con la cédula fiscal correspondiente a tu empresa o persona física.
4. Deberás enviar el método de pago, comprobante de pago y cédula fiscal al correo electrónico solicitado.
5. Una vez que se envié el correo electrónico con los documentos necesario, así como con la información requerida es importante verificar la recepción de la información. DERECHOS DE LOS MIEMBROS DE SYNERGY EDUCATION
Acceso a Servicios: Acceder a los servicios y beneficios especificados en su membresía mientras la membresía esté activa y totalmente liquidada.
• Privacidad: Esperar que su información personal sea manejada de manera confidencial y segura de acuerdo con nuestra política de privacidad.
• Reclamos y Quejas: Presentar reclamos o quejas sobre los servicios recibidos, y recibir una respuesta oportuna por parte de nuestro equipo de soporte.
RESPONSABILIDADES DE LOS USUARIOS DE Synergy Education
•Información Veraz: Proporcionar información precisa y actualizada al registrarse y mantenerla actualizada durante la duración de la membresía.
• Cumplimiento de Términos: Cumplir con todos los Términos y Condiciones establecidos, incluyendo el pago puntual de las tarifas de membresía.
•Uso Responsable: Usar los servicios de membresía de manera responsable y no participar en actividades ilegales, fraudulentas o que puedan dañar a otros usuarios o al proveedor.
•Confidencialidad: No compartir información exclusiva o acceso a los servicios de membresía con terceros no autorizados
• Usted acepta no hacer ni permitirá a otros:
- Licenciar, vender, alquilar, arrendar, asignar, distribuir, transmitir, alojar, subcontratar, divulgar o explotar comercialmente la plataforma o poner la plataforma a disposición de terceros.
- Modificar, realizar trabajos derivados, desensamblar, descifrar, realizar una compilación inversa o realizar ingeniería inversa de cualquier parte de la plataforma.
- Eliminar, alterar u ocultar cualquier aviso de propiedad (incluido cualquier aviso de derechos de autor o marca registrada) de sus afiliados, socios, proveedores o licenciatarios de la plataforma.
NOTIFICACIONES.
Las notificaciones a los usuarios de derivadas de las transacciones comerciales que correspondan Synergy Education, serán hechas por escrito al correo electrónico o datos de contacto que proporcionó el usuario al momento de su registro.
Las notificaciones, comentarios o comunicaciones que desee formular el usuario deberán realizarse por medio de Synergy Education o, en su defecto, a través de los medios de contacto de Synergy Education: llamando al número telefónico +52 3322270561, y/o correo electrónico [email protected]
PROVISION DE SERVICIOS.
Synergy Education se compromete a proporcionarle los servicios que hayan sido contratados aplicando para ello la máxima diligencia en la prestación del Servicio, así como a cuidar del mantenimiento de las instalaciones necesarias para el funcionamiento de la red, disponiendo para ello de un equipo técnico e informático adecuado.
Synergy Education no garantiza que la disponibilidad de los servicios proporcionados por Synergy Education sea continua e ininterrumpida, por circunstancias originadas por problemas en la red de Internet, averías en los dispositivos informáticos y otras circunstancias imprevisibles.
De manera que Usted acepta soportar dentro de unos límites razonables los inconvenientes y dificultades originados por estas circunstancias.
En caso de que la prestación del Servicio por Synergy Education requiriese del empleo de tecnología específica, Synergy Education se obliga a informarle sobre esta tecnología específica con carácter previo a la prestación de los servicios que la requiriesen.
RESERVA DE DERECHOS.
Nos reservamos el derecho a suspender o cancelar nuestros servicios en cualquier momento debido a inconvenientes imprevistos que puedan afectar la realización del programa.
Cualquier decisión en este sentido será comunicada a los participantes lo antes posible.
FUERZA MAYOR.
Ninguna de las partes será considerada responsable por el incumplimiento de cualesquiera de sus obligaciones en tanto en cuanto la prestación del Servicio se retrase o se hiciese imposible como consecuencia de Fuerza Mayor. Se entiende por fuerza mayor todos aquellos supuestos en los que concurran circunstancias imprevistas, o que, pese a su previsión, fueran inevitables, que no dependan de la voluntad de las partes o que escapen de su control, y que no puedan ser evitadas por ellas, y motiven la imposibilidad de cumplir, en todo o en parte, las obligaciones de las partes o hagan extremadamente oneroso para la parte afectada dicho cumplimiento, siempre que no haya mediado negligencia o culpa por su parte.
La suspensión de las obligaciones contractuales durará en tanto en cuanto persista la causa que haya originado la Fuerza Mayor. La parte que sufra ésta deberá ponerlo inmediatamente en conocimiento de la otra, en el plazo máximo de 48 horas desde que la causa de Fuerza Mayor se produzca, y efectuar los esfuerzos que sean razonables para resolver la causa de la suspensión en el plazo más corto posible.
Si la causa de Fuerza Mayor se prolongara en el tiempo de manera que se frustrase la prestación del Servicio, o, en todo caso, si se prolongase por más de tres meses, la parte no afectada por dicha situación podrá, con un preaviso de quince (15) días, instar la resolución del contrato.
PERMISO DE GRABACIÓN DE IMÁGENES, VIDEOS Y AUDIO.
Al aceptar estos Términos y Condiciones, Usted autoriza a Synergy Education a la captación de imágenes de su persona, en fotografía o video, con o sin voz durante el curso, ya sea de modo presencial o en línea por cualquiera de la plataforma que Synergy Education proporcione o indique para la realización del curso elegido por Usted.
Autoriza, asimismo, a Synergy Education a utilizar el material fílmico que provea en la grabación total y/o parcial de su imagen, voz, opiniones, declaraciones, comentarios y/o reacciones (en adelante “imagen”) para su divulgación y/o publicación en la página web, redes sociales y demás canales online y de comunicación de Synergy Education o de sus terceros.
Autoriza a Synergy Education a utilizar la Imagen grabada a fin de que la misma sea publicada y/o incorporada en los videoclips y/o cualquier otro producto audiovisual, vinculado directa y/o indirectamente al mismo, para los fines que Synergy Education crea convenientes y pertinentes.
PROTECCION DE DATOS.
A través de la aceptación de los presentes Términos y Condiciones por parte de Synergy Education, Usted acepta el Aviso de Privacidad de nosotros.

EL sitio web podrá incluir hipervínculos o enlaces que permitan acceder a páginas web propiedad de JAC 7 S.A.PI. DE C.V..
Synergy Education se reserva el derecho a modificar su Política de Privacidad, de acuerdo a sus necesidades o derivado de algún cambio en la legislación.
TERMINACIÓN.
Synergy Education puede cancelar y/o terminar la prestación del servicio de cualquier usuario, de manera enunciativa más no limitativa:
1. Incumpla estos Términos y Condiciones.
2. Realice actividades ilegales o fraudulentas.
3. Robe el contenido.
4. Realice algún altercado en eventos.
5. Acuda en estado de embriaguez o haber consumido alguna sustancia o droga.
6. En los eventos presenciales, no podrán acudir personas menores de edad.
7. Está prohibido acudir a un evento presencial con alimentos o bebidas.
8. No seguir el Código de Conducta.
POLÍTICA DE DEVOLUCIÓN Y/O REEMBOLSO.
Al realizar una compra en Synergy Education, acepta los términos establecidos a continuación así como los Términos y Condiciones de los cursos, programas y/o servicios en lo individual que desee adquirir parte de Synergy Education junto con el Aviso de privacidad de Synergy Education.
El usuario de Synergy Education no podrá tener el derecho a solicitar un reembolso ni devolución de ningún tipo si:
• No se conectó a las mentorías en las fechas establecidas.
• No acudió a los eventos presenciales que se realizan.
• No cumpla con el periodo de tiempo de 3 meses.
Synergy Education se reserva el análisis y/o aprobación de los motivos de solicitud de devolución y/o reembolso, sin embargo, no se podrá solicitar la devolución o reembolso por alguna de las siguientes situaciones, mencionando manera enunciativa mas no limitativa:
• Terminé un curso y/o programa y no me gustó.
• Después de haber empezado el curso, me pareció poco interesante.
• Compre una oferta de Synergy Education y deseo cambiar uno de los cursos incluidos en la membresía.
• No entiendo el curso.
• Pensar que la mentoría es personalizada.
• No se otorgarán reembolsos, reprogramaciones ni cambios de titularidad por situaciones personales ajenas a la organización, incluyendo, pero no limitadas a: enfermedades, accidentes , cambios de agenda, problemas de transporte o cualquier otra situación imprevista.
Al confirmar su compra, el cliente reconoce y acepta que su lugar ha sido reservado de forma exclusiva y que los pagos realizados no son reembolsables, salvo en casos en los que la cancelación sea atribuible directamente a la organización.
CAMBIOS EN NUESTRA POLÍTICA DE DEVOLUCIÓN Y/O REEMBOLSO.
Podemos actualizar, enmendar o realizar cambios en este documento para que reflejen con precisión nuestro Servicio y nuestras políticas. A menos que la ley exija lo contrario, esos cambios se publicarán de manera destacada aquí. Luego, si continúa utilizando el Servicio, estará sujeto a los Términos y Condiciones actualizados. Si no desea aceptar esta o cualquier Política de devolución y reembolso actualizada, puede eliminar su cuenta.
INDEMNIZACIÓN.
Usted acepta indemnizar y eximir de responsabilidad a Synergy Education y a sus empresas matrices, subsidiarias, afiliadas, funcionarios, empleados, agentes, socios y otorgantes de licencias (si corresponde) de cualquier reclamo o demanda, incluidos los honorarios razonables de abogados, debido a que surja de su:
a) Uso de la plataforma;
b) Violación de este Acuerdo o cualquier ley o reglamento; o
c) Violación de cualquier derecho de un tercero.
LIMITACIÓN DE RESPONSABILIDAD.
Usted acepta que en ningún caso la responsabilidad de prime mover ante usted por cualquier reclamo de cualquier tipo o descripción excederá la cantidad pagada por usted a prime mover en los doce meses anteriores a los hechos que dan lugar a cualquier reclamo por su parte. Usted renuncia a cualquier derecho a daños especiales, indirectos o consecuentes de cualquier tipo o descripción.
RENUNCIA A LA DEMANDA COLECTIVA
Usted comprende y acepta que no tendrá derecho a participar en calidad de representante o como miembro de ninguna clase de demandantes en relación con ninguna reclamación que pueda surgir en virtud de los presentes Términos y Condiciones. Las reclamaciones presentadas contra Synergy Education no pueden unirse ni consolidarse con reclamaciones presentadas por cualquier otra persona.
PROPIEDAD INTELECTUAL.
Todos los títulos, contenidos, textos, fotografías, publicaciones periódicas, obras literarias, logotipos, vídeos, dibujos, imágenes, diseños gráficos, videos, audios, incluyendo, a título ejemplificativo, obras y grabaciones audiovisuales, y cualesquiera otros signos elementos o creaciones susceptibles de protección por derechos de propiedad intelectual o industrial que formen parte o sean accesibles a través de esta página web son propiedad de Synergy Education, o de los terceros que los suministran bajo autorización expresa a Synergy Education.
Usted únicamente podrá utilizar el Servicio de forma no exclusiva, para uso estrictamente privado y con sujeción a los presentes Términos y condiciones.
El acceso y uso por Usted de los cursos, programas y/o servicios contenidos en esta página web en modo alguno implicará la renuncia, o la transmisión total o parcial de derechos a Usted por Synergy Education o por sus titulares.
Usted no podrá realizar acto alguno, en relación con el Servicio, cursos ni con los contenidos que se muestran a través del mismo, de reproducción directa o indirecta, fijación, distribución, puesta a disposición del público, comunicación pública, transmisión, retransmisión, edición, adaptación, transformación, modificación o alteración de su contenido en todo o en parte, con carácter provisional o permanente, y en general, utilizarlo de cualquier otra forma que contravenga la legislación en materia de propiedad intelectual.
En cualquier caso, queda absolutamente prohibido el uso comercial, copia, grabación, almacenaje, descarga, distribución, publicación y el empleo de cualquier técnica de ingeniería inversa o de des compilación de los elementos que integran el Servicio, cursos y de los contenidos que a través de este se muestran, en todo o en parte, así como la realización de procedimientos distintos a los autorizados por Synergy Education. Usted no podrá alterar o suprimir las indicaciones de reserva de derechos, créditos identificativos de los titulares de los derechos de los cursos y contenidos ofertados, así como de los mecanismos de protección incorporados a los mismos si los hubiere.
Nos reservamos el derecho de revisar, eliminar o rechazar cualquier contenido generado por el usuario que viole estos términos o sea considerado inapropiado.

FORCE MAJEURE

COMPLAINTS AND CLARIFICATION PROCEDURE
Complaints or clarifications filed by the user must be submitted in writing through the contact methods indicated by the user in these Terms and Conditions.
